In consideration of my use of the Family Camp at Yosemite facilities provided by the City of San Jose (the Company) for the Breathe In Yosemite Retreat, I expressly agree and contract, on behalf of myself, my heirs, executors, administrators, successors and assigns, that the Company and its insurers, employees, officers, directors, and associates, and any Breathe In Yosemite (BIY) staff, volunteers, or third party service providers, shall not be liable for any damages arising from personal injuries (including death) sustained by me on, or about the premises, or as a result of the use of the facilities, regardless of whether such injuries result, in whole or in part, from the negligence of the Company, and/or BIY. By the execution of this agreement, I accept and assume full responsibility for any and all injuries, damages (both economic and non-economic), and losses of any type, which may occur to me, and I hereby fully and forever release and discharge the Company and/or BIY, its insurers, employees, volunteers, officers, directors, and associates, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated, or unanticipated, resulting from or arising out the use of said facilities. I expressly agree to indemnify and hold the Company and/or BIY harmless against any and all claims, demands, damages, rights of action, or causes of action, of any person or entity, that may arise from injuries or damages sustained by me. I agree to be solely responsible for my safety and well-being. I understand that the Company and/or BIY does not provide supervision, instruction, or assistance for the use of the facilities. I understand that this is “Bear Country” and no food is allowed in the tent cabins at any time. Bears recognize coolers as food storage units so do not leave them in your vehicle in plain sight.

I agree to comply with all rules imposed by the Company and/or BIY regarding the use of the facilities. I understand that due to the high fire danger, this is a “no tolerance” environment for any open flame, including smoking outside of the designated areas. I understand that smoking in or around the cabin assigned to me for my personal use is not allowed and may result in being asked to leave camp.

I understand and agree that the Company and/or BIY is not responsible for property that is lost, stolen, or damaged while in, on, or about the premises, including in or around personal vehicles.

NOTE: Bring snacks if you must, but remember this is bear country and all bear safety rules must be followed. High fire danger: absolutely no open flames. Battery powered lanterns are allowed. Smoking is allowed in designated areas only. Failure to comply with posted safety regulations may result in expulsion from Family Camp without refund.

BY CLICKING BELOW I ACKNOWLEDGE THAT I AM AT LEAST 18 YEARS OF AGE, AND I HAVE READ THE FOREGOING WAIVER AND RELEASE OF LIABILITY AND VOLUNTARILY EXECUTED THIS DOCUMENT WITH FULL KNOWLEDGE OF ITS CONTENT.
